Worker Adjustment and Retraining Notification

California Labor Code 1400-1408 addresses the issue of employers of 75 or more persons within the preceding 12 months, giving employees adequate notification of a mass layoff, relocation or termination of employment. Subject to certain exceptions, the employer is required to give the employees 60 days notification before the layoff, relocation or termination takes effect. The employees entitled to the notification as of this writing are persons employed by that employer for at least 6 of the 12 months preceding the date the subject layoff, termination or relocation notice was required. If you believe you were entitled to the subject layoff, termination or relocation 60 days notice and did not receive it, you should discuss with an attorney who handles employment cases to determine if you are entitled to damages.
